Justice is presently defined by many people as the moral rightness and the act of administering the correct punishment for those who deserve it. Many people argue that justice is an act of being fair especially when solving conflicts or issues. They believe that justice prevails when the wrongdoer get his deserved punishment fairly for the mistake or the crime they had committed. One of the important aspect that people do not really understand is that justice should be equal for all but not just being fair. To be fair does not necessarily mean that there is equality. In simple terms, fairness is the practice of following the rules and acting in a manner that is not biased. Can it be fair if an individual punches another person and the other person cannot punch back because it is contrary to the rules, or can it be fair is the other person throws a punch back to ensure that the both parties are equal? According to morals, throwing a punch back is not correct, however, the act can be considered to be justified since it serves as an equal punishment.
The challenge with the concepts of deserved and morally correct definition is that there no longer exists any channel to tell if an action is evidently morally deserved or correct. The religions are the greatest contributor of morals in the society with most of them derived from then Biblical teachings of the Ten Commandments, the philosophies of Allah in the case of Muslims. Religion is no longer popular in the modern world the way it used to be in the past. The love for religion has greatly declined, mutated, changed and as a result the morals in the society have changed. In the modern world, people have different views on various issues that are considered morally correct. In the case that the correct definition of what is considered morally correct does not exist, then justice cannot be expected to be morally served. In addition, there will no channel to make a decision on what is deserved. Morally correct and deserved share a similar problem, there exists any set of definition, therefore, it should be expected that justice can be a deserved reward or punishment.
Justice started as a name used by the individuals who gave out judgment and punishment for those people who had committed various offenses. The practice started in c. 1200 in England. Since then, the use of the word has spread to several people using it as a name and concept. The meaning of justice as the spread of judgment began in 1303. Even though the concept of justice was altered, the word still remained unchanged. In the modern world, justice is exhibited when an individual goes in front to a judge, mainly in courts, presents a case, and the judge makes a decision that the individual is guilty or not guilty. The criminal is then awarded a pre-approved punishment by the state and the federal government. The delivery of the punishment to the criminal is what is said to be morally correct and also the technique of delivering the punishment to the criminal is what is deserved. The issue is that there is no justice here. A morally correct justice cannot be exhibited the modern world. Today’s justice should embrace the need of a having equal justice than the application of a morally correct punishment.
Committing a crime should be equally paid off by the offender. Money stolen should also be returned in double. This examples are used to demonstrate that justice should not be a matter of fairness but ensuring that the victims of a specific crime are equally paid or rewarded. In addition, this is a form of justice that is equivalent to the actual that was committed. The morally correct punishment does not exists because a true definition does not exists. In addition, such justice is not essentially deserved since the true definition of deserved does not exist. The decision to have equal punishments is an implication that it is absolutely fair to all the individuals who were required to get punished. This will make people understand the punishment of the crime before they commit it. They will understand that the punishment will be given that is equal to the crime they committed and also they will face justice.
